This privacy policy applies when you visit the www.tesla2used.com website (hereinafter collectively referred to as the "Site"), whether you are acting on this Site as a professional or non-professional seller, a buyer or a simple unregistered visitor.
In the course of our business, we may process information about you.

We attach great importance to respecting your privacy, as well as the security and confidentiality of your personal data.

Consequently, we undertake to process your personal data in compliance with French and European regulations on the protection of personal data, in particular : Law no. 78-17 of January 6, 1978 relating to information technology, files and freedoms as amended (hereinafter referred to as "the Data Protection Act"), Regulation EU 2016/679 of April 27, 2016 published in the Official Journal of the European Union on May 4, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as "the Regulation"), directly applicable since May 25, 2018, as well as any other French or European regulations that may come to apply in terms of personal data protection.

§1 Where does your personal data come from?

The personal data that we may process comes from :

  • Data that you communicate when you use our Site and/or when we exchange information by e-mail or otherwise;

This includes, for example, data you enter in a registration form when you create an account on our Site or in a contact form.

  • Data that we collect by means of cookies and/or equivalent technologies;

These cookies and other tracers record and transmit to us information about the pages you consult, the time you spend on our Site, the searches you perform, the actions you take, etc.

  • Data we receive from our partners;

Our partners may send us information about you that they collect by means of cookies or other tracers on our Site, on their own sites and applications, or more generally in the course of their business.

 

§2  What information do we process?

We process some or all of the following data:

  • Information about your identity (your title, surname(s), first name(s), postal address, e-mail address, landline and/or mobile telephone number, etc.);
  • Information about your professional activity, such as the position or functions you hold within the entity that employs you, your professional contact details: e-mail address, telephone number, fax, etc., if you are acting as a professional seller;
  • Information about the property offered for sale on the Site (e.g. registration number, VIN number, technical and administrative details of the vehicle registration document, selling price, photographs, videos, etc.);
  • Information relating to the ad placed by a seller on our Site (ad reference, publication date, etc.).
  • Information we receive in connection with orders and transactions (details of the purchase you have made, the purpose and number of the transaction, data relating to the payment method(s) you have used, balances and outstanding payments, etc.);
  • Data relating to the follow-up of our commercial relations (your billing address, purchase history, correspondence with the after-sales service, data resulting from satisfaction surveys, etc.);
  • Information relating to your browsing on the Site, such as the URLs of pages visited, your browsing path to, on or from our Site (including the date and time of browsing), page response times, error messages, data relating to your interaction with our Site (page scrolling, your clicks, your mouse cursor, etc.), as well as with commercial prospecting e-mails and/or SMS that we may send you;
  • Information required to carry out our canvassing, surveys and promotional activities;
  • Information related to the device you are using, in particular :

- The type of device you use (smartphone, tablet, computer, etc.);

- Your device's operating system (iOS, Android, Windows, BlackBerry, etc.);

- Your Internet service provider (Orange, SFR, Bouygues, Free, etc.);

- Your browser (Safari, Chrome, Internet Explorer, etc.);

- The advertising ID linked to your device's operating system;

- Your device's IP address;

- Your device's geolocation data;

- Your MAC (Media Access Control) address;

- Your language preferences.

  • Information about the advertisements we deliver to you and, if applicable, which have been delivered to you:

- The url and/or subject of the web or mobile site or application where you (have) browsed and where the advert is likely to be delivered to you and, where applicable, has been delivered to you;

- Details of the advert that is and, where applicable, has been delivered to you;

- Your behavior in relation to the ad (time spent on the ad, clicks, etc.);

- Your behavior after clicking on the ad (contacting the seller, browsing our Site, etc.);

- The number of times you have seen the advertisement delivered by us.

We do not process sensitive data about you (your religion, political opinions, health, trade union membership, sexual preferences, etc.).

Our Site and our services are not intended for minors. Consequently, we take all possible steps to prevent the collection and processing of personal data from minors under the age of 15.

§3 For what purposes is your data processed?

We collect and/or process your personal data in order to :

  • Manage our commercial relationship with you, if you are a customer, and thus enable you in particular to place orders, access our customer service, obtain an invoice for your order, ask us questions, inform us of any complaints and/or observations, etc. ;
  • Manage the contact between sellers and Internet users (potential buyers) on our Site (provision of the seller's telephone number and a contact form, or by means of e-mail alerts and mobile notifications);
  • Manage the relationship between Internet users and our financial partner or the financial partners of professional sellers on our Site (provision of a contact form);
  • Collect, publish and moderate a posteriori the opinions of Internet users following a connection between professional sellers and potential buyers on our Site;
  • Manage the publication of professional sellers' rights of reply;
  • Manage our prospecting operations (and thus enable you to receive by e-mail and/or SMS, our news, advice or offers concerning our products and/or services, our activities, our promotional operations, our events (alerts, invitations and other publications), etc., as well as those of our partners);
  • To profile your data in order to send you relevant advertisements for products and services adapted to your needs, and to personalize your experience on our Site by proposing content likely to be of interest to you;
  • Evaluate the performance of our advertising campaigns and report to our partners;
  • To compile business statistics on our operations, our activity, our market, trends, the products and/or services we develop, customer satisfaction, etc. ;
  • Measure the audience of our Site, evaluate its use and improve its content;
  • Monitor the technical performance of our sites, identify and resolve computer malfunctions;
  • Evaluate and train our customer service advisors and account managers;
  • Enable you to interact with and publish content on our Site, where permitted;
  • Manage unpaid invoices and disputes;
  • Carry out anti-fraud operations, in particular e-mail analysis for the purpose of detecting unsolicited content and malicious computer programs.
  • Offer you polls and surveys;
  • To manage your requests to exercise your rights under article 10 hereof;
  • Notify you of any changes to our Site;

 

§4 What is the legal basis for processing your data?

The processing of your data is generally based on our legitimate interest in performing, improving and optimizing relations with our customers and prospects.

It may also be based on the performance of a contract (for example, when you subscribe to a service) or the performance of pre-contractual measures taken at your request (for example, a demonstration of a product or service or an estimate).

Lastly, some of the processing we carry out is based on our legal obligations.

However, in the following cases in particular, the processing of your data is based on your express and specific consent (which will be collected via a checkbox for example, or any other relevant positive action on your part, which will be indicated to you):

  • The use of your data for commercial prospecting purposes (by e-mail, telephone, SMS, etc.). However, prospecting by e-mail and/or SMS will not require your consent if you are already one of our customers and if the e-mail and/or SMS we send you concerns products or services similar to those we have already provided to you;
  • The use of your data transmitted by certain types of cookies (including cookies used for targeted advertising);
  • The re-use of your data for purposes other than those referred to in article 3 hereof.

As indicated in article 10 below, you may revoke this consent at any time.

For example, if you no longer wish to receive commercial prospecting e-mails and/or SMS messages from us, you can let us know under the conditions set out in article 10 below, or use the unsubscribe function provided for this purpose in the e-mail and/or SMS message we send you (generally, a clickable unsubscribe link at the end of the message).

We will do our utmost to process your request as soon as possible and to inform the recipients of your data accordingly.

§5 Who processes your data?

The person responsible for processing your personal data is :

  • The simplified joint stock company Tesla2Used
  • The recipients of this data are :
  • Authorized staff of our company's marketing, sales, customer service, canvassing, administrative, logistics and IT departments, as well as their line managers;
  • Authorized staff of companies belonging to the same group as ours;
  • Authorized personnel of auditing departments (statutory auditors, departments responsible for internal audit procedures, etc.);
  • Authorized personnel of our business partners, financial partners, service providers and subcontractors, as well as any person involved in the execution of the contract concluded with you (for example, service providers supplying us with data hosting services or our partners involved in advertising), it being specified that we ensure that these persons present serious guarantees of security and confidentiality of the personal data that we transmit to them;
  • Bodies, auxiliaries of justice, ministerial officers, and judicial and administrative authorities, under the conditions provided for by law;
  • Any authorized person, when we are obliged to disclose and/or share your personal data in order to fulfill our legal obligations;

The use of your personal data by third parties is governed by their own privacy policies.

§6 Where is your data processed?

Your data is processed mainly within the European Union.

Nevertheless, when our relations with partners, subcontractors or third parties involve cross-border exchanges of your personal data outside the European Union, we ensure that these transfers are made to countries offering an adequate level of protection, or that they are governed by legal instruments guaranteeing a level of protection for such transfers that complies with European requirements (for example, through the conclusion of European Commission Standard Contractual Clauses, or through the adoption by the entities concerned of Binding Corporate Rules that comply with the Personal Data Regulations).

In any event, you consent to the processing of your personal data outside the European Union under these conditions.

§7 How is your data protected and stored?

Security is one of our core concerns.

Accordingly, we implement appropriate technical and organizational measures, including physical, hardware and software measures, to preserve the security, integrity and confidentiality of your personal data, and to protect it from access, use, misappropriation, modification, disclosure or destruction by unauthorized persons.

For example, we use security measures (including staff authentication) for our premises, our IT tools, our internal IT network and servers, data back-up, activity logging, data security during IT development and maintenance operations, anomalies and events relating to data security, archiving measures, and protection in the event of data exchange (e.g. the "https" protocol).

In addition, access to your personal data is strictly reserved to certain of our employees specifically designated for this purpose within the framework of their mission.

We also require data recipients to provide sufficient guarantees of security and confidentiality.

Furthermore, in compliance with the Regulation, we undertake to notify you of any security breach likely to give rise to a high risk to your rights and freedoms, unless such communication proves unnecessary as provided for in the cases referred to in Article 34 of the Regulation.

§8 How long do we keep your data?

Concerning data relating to the management of our customers and prospects:

Data relating to our customers will be kept for five (5) years after the end of the contract, for whatever reason. If you are one of our customers, your data used for commercial prospecting purposes will be kept for a maximum period of one (1) year from the end of our commercial relationship (for example, from the date of a purchase by you, or the last contact from you).

If you are one of our prospects, not yet a customer, your data will be kept for a period of one (1) year from the date of collection or from the last contact from you (such contact corresponding, for example, to the case where you ask us for documentation or click on a hypertext link contained in one of the e-mails and/or SMS that we send you for canvassing purposes).

At the end of this one (1) year period, we undertake to delete your personal data.

Telephone recordings made by our Call Center for the purpose of improving our services and training and evaluating our customer advisors are kept for a period of six (6) months from the time of recording.

Concerning identification:

If you exercise your rights of access or rectification under article 10 below, data relating to your identity document will be kept for a period of one (1) month.
If you exercise your right to object as described in article 10 below, this data will be archived after a period of one (1) year.

Concerning credit card data:

Your credit card details will not be kept beyond the time required to complete each transaction.

Concerning the management of lists of opposition to receiving canvassing:

If you exercise your right to object to receiving canvassing, the information enabling your right of objection to be taken into account will be kept for three (3) years from the date on which you exercise this right.

Concerning audience measurement statistics:

The information stored in your terminal (for example, thanks to cookies), or any other element used to identify you and allow your traceability, will not be kept beyond thirteen (13) months. Any new visits you make to our Site will not extend the life of this information.

Raw traffic data associated with an identifier will not be kept for longer than thirteen (13) months.

After this period, your data will either be deleted or anonymized.

Concerning your account data on one of our Sites

When you create an account on our Site, the data will be deleted as soon as the account is deleted (subject to the data corresponding to the aforementioned cases).

Your account will be considered inactive after 3 years from the last time you use it. At the end of this period, the data relating to your inactive account will be deleted (subject to the data corresponding to the aforementioned cases).

In any event, should we continue to process your data regardless of the deletion of your account, you will have the right to exercise the rights set out in article 10 below.

§9 Cookies

A "cookie" is a computer file designed to collect information from your terminal. For more information on the types of cookies we use, their purposes and how to object to them.

Cookies used by third parties for programmatic advertising: The list of our partners who place cookies on our services is not exhaustive, as it does not include certain cookies placed by third parties for programmatic advertising (real time bidding or "RTB"). The identification of the deposit of cookies in this context can only be technically ascertained after the deposit and only for the duration of the programmatic campaign.

Our cookies - particularly those that are strictly necessary for the provision of our service or based on our legitimate interests - do not require your prior consent (e.g. session ID cookies, authentication cookies, domains, etc.).

Some cookies deposited by third parties do not also require your consent for the above-mentioned reasons (for example, exempt audience measurement cookies benefiting from a consent exemption, consent management cookies, cookies for performance measurement, security, improving our services or technical monitoring, etc.).

§10 What are your rights with regard to the processing of your data?

In accordance with the French Data Protection Act and the Regulation, you have the right to access, oppose, rectify and delete your personal data.

If you have created an account on our Site, you can modify some of your data directly on the account, or even delete your account directly.

You can obtain the deletion of your personal data (except if they are necessary for the performance of the services, or if they are necessary for us to comply with our legal obligations or to establish, exercise or defend legal claims), if at least one of these situations corresponds to your case:

- your data is used for prospecting purposes;

- the data is not or is no longer necessary for the purposes for which it was originally collected or processed;

- you withdraw your consent to the use of your data;

- your data has been processed unlawfully (e.g. publication of pirated data);

- your data was collected when you were a minor in the context of the information society (blog, forum, social network, website, etc.);

- your data must be deleted to comply with a legal obligation;

- you have objected to the processing of your data and the data controller has no legitimate or compelling reason not to comply with your request.

You also have the right to give us instructions on how you would like your personal data to be handled after your death (for example, whether you would like it to be stored, deleted or passed on to a designated third party).

Finally, you can ask us to delete your personal data that was collected when you were a minor.

You may also exercise (in addition to the aforementioned rights), your rights to limitation of processing and your right to portability of your personal data, as provided for by the Regulation.

You also have the right to withdraw your consent to the processing of your personal data (if the processing we carry out is based on your consent).

Lastly, you may exercise your right not to be subject to a decision based exclusively on automated processing (such as profiling, for example) producing legal effects concerning you or significantly affecting you.

You also have the right to lodge a complaint with a supervisory authority regarding the processing of your personal data (such as the CNIL).

These rights may be exercised:

  • By you, with regard to your personal data;
  • By the person(s) exercising parental authority, if you are a minor;
  • By your legal representative, if you are under guardianship;
  • By the heirs of the deceased.
  • If your rights are exercised through one or more of these persons, they will receive the information resulting from the exercise of these rights.

To process your request, we will need to know your identity.

We may therefore request a photocopy of one of your identity documents bearing your signature. We will only keep this copy for as long as is necessary to process your request (subject to the specific time limits set out in article 8 above).

You must also specify the address to which the reply should be sent.

Your request does not need to be justified, unless you exercise your right to object. If you wish to exercise your right to object, you will need to provide "reasons relating to your particular situation", except where your data is processed for canvassing purposes, in particular commercial canvassing.

§11 Modification of the privacy policy

We reserve the right to modify this Privacy Policy at any time and without notice.

We invite you to regularly consult the present confidentiality policy accessible on our Site, in order to take note of any possible modifications.

Whenever necessary, we will notify you by e-mail of any changes to this Privacy Policy.
